Agreement

By accessing or using Nossa, you agree to these Terms. If you do not agree, do not use the site, join the waitlist, request early access, or purchase any product or service.

We may update these Terms from time to time. The version posted on this page will apply when you use Nossa after the update becomes effective.

Eligibility

You must be able to form a binding agreement to use Nossa. If you use Nossa on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Early access and product availability

Nossa may offer waitlists, invitations, limited releases, reservations, deposits, pre-orders, or early access pricing. Availability, timing, pricing, specifications, finishes, and features may change before final release.

An early access request does not guarantee allocation, delivery timing, or continued availability. If payment is collected, applicable payment, cancellation, shipping, tax, and refund terms will be presented at checkout or in a separate written confirmation.

Product information

We try to present Nossa products accurately, but images, colors, materials, sizing, technical specifications, and descriptions may vary by device, lighting, production run, prescription requirements, and final manufacturing.

Nossa products and services are not a substitute for professional medical, legal, financial, safety, or emergency advice. You are responsible for using products and services lawfully and safely.

Accounts and communications

If you provide information to join a waitlist, request access, purchase, or communicate with us, you agree that the information you provide is accurate and current.

You consent to receive transactional and service-related communications. Marketing communications may be sent where permitted by law, and you may opt out as described in those messages.

Acceptable use

You may not misuse Nossa, interfere with the operation of the site or services, attempt unauthorized access, scrape or copy content in violation of these Terms, use Nossa for unlawful activity, or infringe the rights or privacy of others.

Intellectual property

Nossa, AirCaps, and all related names, logos, product designs, imagery, copy, interfaces, software, and other materials are owned by AirCaps, Inc. or its licensors and are protected by intellectual property laws.

You receive a limited, revocable, non-transferable right to access and use the site and services for personal, lawful purposes. No ownership rights are transferred to you.

Third-party services

Nossa may link to or integrate with third-party services, platforms, payment processors, analytics providers, communications tools, or AI services. Those third parties may have their own terms and policies, and we are not responsible for their services.

Disclaimers

To the fullest extent permitted by law, Nossa is provided on an as-is and as-available basis without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the site, services, products, or early access programs will be uninterrupted, error-free, secure, or available at any particular time.

Limitation of liability

To the fullest extent permitted by law, AirCaps, Inc. and its affiliates, officers, employees, agents, partners, suppliers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities.

Our total liability for any claim arising out of or relating to these Terms, Nossa, or any product or service will not exceed the amount you paid to AirCaps, Inc. for the product or service giving rise to the claim, or one hundred U.S. dollars if no payment was made.

Governing law

These Terms are governed by applicable law, without regard to conflict of law principles, except where local law requires otherwise. Any dispute will be handled in the courts or forums that have proper jurisdiction over the parties and the dispute.
